Terms of Use

ToneMusicVibe (tonemusicvibe.com) is an online music service for personal, non-commercial listening. By using the site, you accept these terms and the privacy policy (tonemusicvibe.com/privacy). The service does not sell music rights. Questions: support.tonemusicvibe@gmail.com.

1. General provisions

1.1. Service: ToneMusicVibe, website https://tonemusicvibe.com and related pages.

1.2. Operator / developer: the ToneMusicVibe project team (individual developer; a legal entity may be listed when a mobile app is published in app stores).

1.3. These Terms of Use apply together with the Privacy Policy: https://tonemusicvibe.com/privacy.

1.4. Registration, sign-in, listening to music, playlists, and submitting forms mean you agree to these terms.

1.5. If you do not agree, stop using the service.

1.6. We may update these terms (section 16). By continuing to use the service after a new version is published, you agree to the updated terms unless prohibited by law.

2. Service description

ToneMusicVibe provides (to the extent available on the site):

  • a music catalog for listening via the web player;
  • search across tracks, artists, and sections;
  • playlists — create, edit, and save in your account;
  • track likes;
  • curated sections on the home page and in categories (popular, new releases, genres, etc.);
  • listening statistics for catalog metrics and your experience on the site;
  • a personal account (email/password or Google sign-in);
  • interface language (Russian, English, Ukrainian); contact and DMCA forms; ad units (if shown).

Currently not available on the site:

  • paid subscriptions;
  • a separate AI chat or “mood” feature that sends your text to third-party AI services;
  • sign-in via Spotify, Apple Music, or YouTube Music;
  • user uploads of music files into the catalog;
  • public user profiles and comments.

If such features are added, the terms and privacy policy will be updated.

3. User account

3.1. Some features require registration (email and password with verification) or Google sign-in.

3.2. You agree to provide accurate information (email, name) and keep it up to date.

3.3. You are responsible for keeping your password secure and for access to the email linked to your account. Do not share your account with others.

3.4. If you suspect unauthorized access, change your password and email support.tonemusicvibe@gmail.com.

3.5. We may temporarily restrict or block access for rule violations, suspected fraud or abuse, or as required by law.

3.6. Account deletion is available on request at support.tonemusicvibe@gmail.com (see the privacy policy for details). A dedicated button in your profile may not be available.

4. Age

The service is not intended for users under 13 years of age.

If your country requires a higher age to consent to online services (for example, 16 in some EU countries), you may use the service only when you reach that age or with consent from a parent or legal guardian.

5. Permitted use

  • listen to music from the catalog for personal, non-commercial purposes;
  • use search and site navigation;
  • create and edit your playlists and like tracks;
  • change your name and email in your profile (where available);
  • sign in with Google when the feature is enabled;
  • contact support and submit copyright notices (DMCA);
  • use the site within technical limits we set for stability and security.

6. Prohibited use

  • hacking, bypassing protections, or attempting to access other users’ accounts, the admin panel, or restricted areas;
  • automated data collection (scraping, bots, bulk requests) without our written permission;
  • copying, reselling, or commercial use of the service, catalog, or streams without rights holders’ and our consent;
  • copyright or related-rights violations (unlawful distribution, bypassing rights-holder restrictions);
  • submitting false, offensive, harmful, or third-party information through site forms;
  • distributing viruses or malicious code, or attempting to disrupt the service (DDoS, overload, exploiting vulnerabilities);
  • spam, fraud, or illegal activity;
  • impersonating another person or organization;
  • bypassing technical limits, CAPTCHA, registration limits, or form restrictions;
  • any actions that violate applicable law.

If paid features are introduced, bypassing payment or subscriptions is also prohibited.

7. User content

7.1. User content on the site mainly includes account data (name, email, avatar when signing in with Google), playlist titles and descriptions, likes, and messages submitted through forms (contact, DMCA).

7.2. Users do not upload music tracks to the public catalog through the site; the catalog is managed by the project team via the admin panel.

7.3. You retain rights to content you create (for example, playlist titles), but grant ToneMusicVibe a non-exclusive license to store and display it to operate the service (showing it in your profile, syncing across devices).

7.4. You are responsible for the legality and accuracy of your content.

7.5. We may remove or restrict content and account access if it violates these terms, the law, or third-party rights.

8. Music and copyright

8.1. ToneMusicVibe does not grant you rights to musical works, sound recordings, artwork, titles, lyrics, or other catalog materials.

8.2. Rights to tracks, artwork, and artist information may belong to authors, performers, labels, and other rights holders.

8.3. You agree to use music only as permitted by law and these terms (personal, non-commercial listening through the site, without bypassing technical restrictions).

8.4. The service is not an official rights-holder store or streaming platform. For purchase, licensing, or commercial use of music, contact official sources.

8.5. Playback currently comes from the ToneMusicVibe catalog, not through third-party streaming APIs (Spotify, Apple Music, etc.). If integrations are added, you must also comply with their terms.

8.6. Rights holders may submit complaints through the DMCA section on the site or at support.tonemusicvibe@gmail.com.

9. Recommendations and personalization

9.1. Curated sections (“popular”, “new releases”, genres, home blocks) are based on the catalog, genres, listening statistics, and editorial decisions, not a guarantee of a “perfect mood”.

9.2. Recommendations may not match your expectations; we do not guarantee that every selection will appeal to you.

9.3. There is no separate AI assistant for users on the site. Do not use forms or search to share sensitive personal information.

9.4. We may use likes, playlists, and listening history to improve the interface and statistics as described in the privacy policy.

10. Subscriptions and payments

10.1. ToneMusicVibe currently does not offer paid subscriptions or card payments on the site.

10.2. Ads on the site may link to third-party offers — their terms and payment are governed by third parties.

10.3. If paid features are added (subscription, App Store / Google Play app), we will publish separate terms: pricing, billing period, cancellation, and refunds under the payment provider or store rules. Removing the app icon does not always cancel a subscription — cancel in the store or account settings.

11. Free features and service changes

11.1. Core site features are currently available free of charge (with registration and without a subscription).

11.2. We may change, limit, or discontinue features, catalog sections, design, and technical capabilities without prior notice when needed for development, security, or legal reasons. We will try to announce material changes on the site.

11.3. The service may be temporarily unavailable due to maintenance, updates, or failures at hosting providers and other vendors.

11.4. We do not guarantee that any specific track, artist, or section will remain available permanently.

12. Limitation of liability

12.1. The service is provided “as is” to the extent permitted by law. We make reasonable efforts to keep it running, but do not guarantee:

  • uninterrupted, error-free operation 24/7;
  • absolute accuracy of titles, artwork, metadata, or curated selections;
  • preservation of all data in force majeure, equipment failures, or actions by third parties;
  • operation of third-party services (Google, Cloudflare, hosting, email, analytics);
  • that music will match your mood 100% of the time.

12.2. ToneMusicVibe is not liable for indirect damages, lost profits, loss of data or reputation, unless mandatory law provides otherwise.

12.3. Links to external sites (in ads, contacts, DMCA) lead to third-party resources — we do not control their content.

13. Third-party services

The site may use:

  • hosting and database services;
  • Google — sign-in (OAuth), reCAPTCHA, Analytics / Tag Manager (after cookie consent);
  • Cloudflare — Turnstile (form protection);
  • email services (SMTP);
  • in the future — payment systems, AI/API, and music APIs.

Those services’ terms and policies govern their relationship with you. ToneMusicVibe is not responsible for their actions or availability.

14. Account suspension and deletion

We may restrict, suspend, or delete an account (and related content), including when:

  • these terms are violated;
  • fraud or unauthorized access is suspected;
  • copyright is infringed;
  • illegal activity occurs;
  • abuse is detected (spam, bots, overload);
  • required by authorities or a court.

You may request account deletion at support.tonemusicvibe@gmail.com. After deletion, some data may be retained as required by law, for DMCA disputes, backups, or anonymized statistics (see the privacy policy).

15. Complaints and inquiries

We aim to respond within a reasonable time (typically within a few business days; complex cases may take longer).

16. Changes to these terms

16.1. These terms may be updated. The current version is at https://tonemusicvibe.com/terms with the date shown.

16.2. For material changes, we may notify you via the site or email (if you have an account).

16.3. Continued use after a new version is published means you agree to it unless you stop using the service.

17. Governing law

These terms are governed by the laws of Ukraine unless mandatory consumer-protection rules in your country of residence require otherwise.

Disputes should be resolved through negotiation where possible; otherwise, under applicable law.
